About This Agreement
Buddie (www.buddie.gg) is run by EBOOSTGG LTD, a private limited company incorporated in England and Wales under company number 16883185, with its registered office at Unit 501 Leroy House, 434-436 Essex Road, London, N1 3FY, United Kingdom ("Buddie", "we", "us"). This Sales Agreement is part of our Terms of Service. It sets out the rules for everything on Buddie that involves money.
Everyone on Buddie must be at least 18. You accept this Agreement in the same way you accept the Terms — by creating an account, signing in, topping up, placing an Order or otherwise using Buddie (see Terms › Accepting These Terms). If the Terms and this Agreement say different things about money, this Agreement wins.
Definitions
Customer, Buddie, Service, Order and Coins mean what they mean in the Terms (Terms › Our Service). In this Agreement also:
Wallet: your Coin balance on Buddie. It has two parts — Coins you topped up or got back as a refund, and a Buddie's earnings.
Earnings: Coins a Buddie receives for Orders, tips, gifts, subscriptions and wish contributions. Only earnings can be withdrawn.
Session: the time a Buddie spends providing an Order.
Payout hold: the time a completed Order's payment waits before it reaches the Buddie, so the Customer can report a problem.
Store level: a Buddie's level, set automatically by their store rating. It decides the length of their payout hold.
Processing fee: what a payment provider charges for a card, PayPal or crypto payment, added to the amount you pay.
Coins and Your Wallet
Prices on Buddie are in Coins. 1 Coin is worth 1 US dollar on Buddie.
Coins can only be used on Buddie. They are not money, electronic money or a bank deposit, they earn no interest, and they can't be sold, exchanged for cash or moved to another account except through tips, gifts, subscriptions and wish contributions.
Coins you top up are not refundable or withdrawable, except where the law gives you a right to a refund (see Your Rights as a Consumer). Coins refunded to you, and Coins you receive as a reward or as a gift when you are not a Buddie, can be spent but not withdrawn.
Only a Buddie's earnings can be withdrawn. When you spend, your topped-up Coins are used first and earnings only after they run out.
A Buddie can't use earnings for tips, gifts, subscriptions or wish contributions — only Coins they topped up.
Your Wallet history shows every completed top-up, payment, refund, earning, fee and withdrawal.
Pay Only on buddie
Payments outside Buddie are strictly forbidden. This protects both sides: we can only hold, refund or release money that was paid on Buddie.
Customers and Buddies must not:
- ask for, offer, send or accept money, gifts or any other payment outside Buddie for anything to do with a Service;
- use or suggest another payment method, app or website instead of Buddie;
- share contact or payment details, or otherwise try to move a Customer or a Buddie off Buddie.
Breaking this rule can lead to your account being banned permanently. Anything paid or arranged outside Buddie is at your own risk: it gets no Buddie protection — no payout hold, no report, no refund and no help from support.
Topping Up
You can top up your Wallet by card (through Stripe), PayPal or crypto (through NOWPayments) once your email is verified. One top-up can be at most 10,000 Coins. We may pause payments at any time, for example during maintenance.
A processing fee is added to what you pay. For card and crypto it covers the card provider's percentage and fixed charge; for PayPal it covers PayPal's percentage and fixed charge and its currency conversion. Each method's fixed part includes US$0.10 that we keep. The fee is shown before you pay; on top-ups and card payments it is rounded up to the next 5 cents. You can choose to pay a card payment in euros; it is then charged in euros at the exchange rate we use at that time.
The 199.99, 299.99 and 499.99 packs have a flat processing fee of US$10, US$15 and US$25 instead, whatever the payment method.
Some packs come with bonus Coins: 3 with the 199.99 pack, 6 with the 299.99 pack, 12 with the 499.99 pack and 24 with the 999.99 pack. The bonus depends on the pack you choose.
A promo code or your buyer-level discount lowers the amount you pay for a top-up. The Coins credited to your Wallet equal the amount you actually pay (not counting the processing fee), plus any pack bonus.
A promo code works only if it is active, hasn't expired and hasn't been used up, and only for a top-up of at least its minimum amount, if it has one. Upper or lower case doesn't matter. Only one promo code can be used per top-up.
If a promo code has a limited number of uses, one use is reserved for you when your checkout opens, so nobody else can take it while you pay. If the checkout fails, is cancelled or expires, the use is released. A payment that still arrives later is credited all the same and counts as a use.
Coins are added once the payment provider confirms your payment. A payment that is still pending, or is refused, adds nothing.
Buyer Levels and Rewards
What you spend on Buddie — Orders, tips, gifts, subscriptions, wish contributions and badges — raises your buyer level, shown in the Buyer Hub. An Order counts only once its payment has been released to the Buddie; everything else counts once it is paid. Refunded amounts don't count.
Some levels unlock rewards: badges, bonus Coins (which can be spent but not withdrawn) and a lasting discount on top-ups as described above. Each reward is given once. We may change future rewards; rewards already given stay yours. The top-up discount follows your current level.
Prices and Promotions
Each Buddie sets their own prices — per Session, hour, game or block of minutes — and may set options and a minimum quantity. A Buddie can't list a Service below 1 Coin per unit.
The price you see at checkout is the price you pay. It is worked out on our server with the same rules used to charge you.
Buddies may run their own promotions: a free first Order, a discount on the first Order, or a discount for everyone, limited by date or by number of uses. A first-order promotion applies to your first Order with that Buddie only. Promotions can bring an Order down to 0 Coins. The Buddie receives the price after the promotion.
If you subscribe to a Buddie who offers a subscriber discount, you get the better of the promotion and the subscriber discount on each Order — never both.
A Buddie can send you a service card in chat with a price they set (at least 0.5 Coins per unit) and, if they choose, a fixed number of units. A card is for you only and can be ordered for 24 hours. It is ordered at exactly that price: promotions and subscriber discounts don't apply to it.
Placing and Paying for an Order
When you confirm an Order, it waits for payment. You must pay within 30 minutes, or the Order expires. If you picked a scheduled time slot, it is reserved for you during that time. The Buddie doesn't see an Order until it is paid.
You can have at most 3 unpaid Orders at a time. Pay or cancel one before starting another.
You can pay from your Wallet, or directly by card, PayPal or crypto. Paying from your Wallet has no fee. Paying directly adds a processing fee as described in Topping Up.
If a payment arrives after the 30 minutes have passed, the Order comes back to life rather than being lost. If your time slot was taken in the meantime, agree a new time with the Buddie in chat.
Once you pay, we hold the money. It reaches the Buddie only after the Order is completed and its payout hold has passed.
A service card you didn't pay for can be used again until it expires.
Accepting, Starting and Completing Orders
Accepting: the Buddie must accept a paid Order within 24 hours. If they don't, it is cancelled and refunded in full to your Wallet automatically. The Buddie can also decline it, with the same full refund.
Starting: once they accept, the Buddie must begin the Session within 24 hours. For an Order placed for a time slot, the deadline is 2 hours after the slot's start time instead. If the Session hasn't begun by then, the Order is cancelled and refunded in full automatically. An Order placed for a slot can't be started more than 5 minutes before the slot.
During the Session the Buddie can pause the timer and mark progress (for example "Game 2 of 3"). Neither changes the price.
Completing: the Buddie marks the Order complete when the Session ends. If a Session is left running long after it should have ended — 6 hours past the slot's end or the length bought (2 hours is assumed for an Order by Session or by game), and for an Order without a slot never more than 24 hours after it started — it is completed automatically. Either way, the payout hold then starts and you can still report a problem.
Cancellations and Refunds
Who can cancel depends on where the Order is:
- Waiting for payment: you can cancel it. Nothing was paid, so nothing is refunded.
- Paid, waiting for the Buddie to accept: you can cancel it and get a full refund.
- Accepted, not started: you can send a cancellation request, which the Buddie approves (full refund) or declines (the Order goes ahead). The Buddie can't start the Session until they answer. If they don't answer and the start deadline passes, the Order is cancelled and refunded automatically.
- Started: only the Buddie or our support team can cancel it.
- The Buddie can cancel or decline an Order at any time until it is completed. You get a full refund.
Refunds go to your Wallet as Coins, which you can spend but not withdraw. A refund is the Order price; the processing fee you paid to a payment provider is not refunded. If the law requires a refund to your original payment method instead, open a support ticket.
Our support team can refund an Order at any stage, including after it was completed. Refunding an Order that hasn't finished also cancels it. If the Buddie had already been paid for that Order, the amount is taken back from their Wallet, even if that makes their balance negative.
Support can also cancel an Order and pay the Buddie instead of refunding you, for example when the Customer broke our rules.
If a Buddie's account is suspended or closed, their paid Orders that are waiting, accepted or in progress are cancelled and refunded in full to the Customers' Wallets. Completed Orders follow the normal payout hold and report rules.
If a card payment for an Order is refunded to the card through the payment provider, an Order that hasn't started is cancelled; otherwise its payout is frozen until support decides.
A refunded Order can't be reviewed.
Payout Hold and Reports
After an Order is completed, its payment is held for between 24 and 96 hours, depending on the Buddie's store level: 96 hours at Lv.1, 72 hours at Lv.2, 48 hours at Lv.3 and 24 hours at the two eStar levels. A Buddie without a level yet gets the longest hold. When the hold passes with no open report, the full Order price is added to the Buddie's earnings.
The Customer and the Buddie of an Order can each report an Order from the Order page. Each side can have one open report per Order.
A report made before the Order is completed, or before its payout hold ends, freezes the payout until our support team decides. A report made after the Buddie has been paid doesn't freeze anything, but support can still review it.
Support reviews the report and may ask both sides for information. They may close the report — the payment is then released to the Buddie once the payout hold has passed, straight away if it already has — or refund the Customer, or cancel the Order and pay the Buddie. The person who made the report is told the result.
A Customer can't review an Order they reported.
Tips and Gifts
You can tip the Buddie on an Order that is accepted, in progress or completed, from your Wallet or by card (a processing fee is added for card). Only the Customer of that Order can tip.
You can send gifts in chat from your Wallet — to a Buddie, or from a Buddie to a Customer. Gifts can't be sent to someone who blocked you or who doesn't accept messages from you.
Each tip, and each send of gifts, must be between 1 and 10,000 Coins.
When a Buddie receives a tip or a gift, the Buddie keeps 90% as earnings by default and Buddie keeps the rest. A Customer who receives a gift keeps all of it, as Coins that can be spent but not withdrawn.
Tips and gifts are final and can't be refunded.
Subscriptions
A Buddie can offer a monthly subscription at a price they set, between 1 and 500 Coins a month, with an optional subscriber discount of 5% to 50% on their Orders.
You can subscribe for 1, 3 or 12 months (a month is 30 days) and pay the whole period up front from your Wallet. You can have one subscription per Buddie at a time.
While subscribed you get the subscriber discount (see Prices and Promotions), unlimited chat and the Buddie's subscriber-only photos. Without a subscription or an open Order, you can send a Buddie up to 5 messages until they reply.
Subscriptions renew automatically for the same period, at the Buddie's price at that time, from your Wallet. If your Wallet doesn't have enough Coins, the subscription ends.
You can cancel at any time. Cancelling stops the next renewal; you keep the benefits until the period you paid for ends. Subscription payments are not refunded.
The Buddie receives the payment straight away and keeps 90% as earnings by default.
Wishes
A Buddie can post up to 3 wishes per calendar month (archived wishes don't count), each with a target and, if they like, an end date within 90 days or a monthly repeat.
Anyone else can support a wish from their Wallet, with contributions of 1 to 1,000 Coins, until it is fully funded or ends. A contribution can't be more than what is left to reach the target. You can choose to stay anonymous to everyone except the Buddie.
A contribution is a gift to the Buddie, not a payment for a Service. The Buddie keeps 90% as earnings by default.
Once a wish has been supported, the Buddie can't change what it is for and can't delete it, only archive it. Contributions are not refunded.
Badge Shop
Buddies can buy profile badges in the Badge Shop with Coins from their Wallet. Badges are for display only and are not refunded.
Buddie Earnings, Commission and Withdrawals
A Buddie's earnings for an Order — the full price the Customer paid — are added to their Wallet when the payout hold ends. Tips, gifts, subscriptions and wish contributions are added at once, with Buddie's share already taken off; the withdrawal fee below still applies to them.
Our commission on Orders is taken when you withdraw. You keep 80% by default of each withdrawal and Buddie keeps 20% as the withdrawal fee. We may agree a different rate with a Buddie; the rate that applies is shown before you withdraw.
The minimum withdrawal is 30 Coins. Only earnings can be withdrawn — not Coins you topped up or got as a refund.
You can withdraw by bank transfer (IBAN), PayPal or crypto wallet. The amount leaves your Wallet when you ask. Our team checks and pays each withdrawal by hand. If we refuse it, the whole amount goes back to your earnings.
The payout account must be yours and in your own name, and you must give the account holder's name. A withdrawal to someone else's account is refused, and the account can be banned permanently.
If a refund takes back earnings you already received and your balance goes below zero, new earnings pay off that amount first, and we won't pay a withdrawal until it is cleared.
You are responsible for your own taxes on your earnings.
Payment Disputes and Chargebacks
If you dispute a payment with your bank, card provider or PayPal (a chargeback), please contact us first — we can usually sort it out faster.
When a dispute is opened, all your paid Orders whose money hasn't reached the Buddie yet are frozen.
If the dispute is about a top-up, the disputed amount is held from your Wallet, if your balance covers it.
If the dispute is decided in our favour, the frozen Orders and the held Coins are released. If it isn't, they stay frozen and our team decides what happens to them.
If a card top-up is refunded to your card, the Coins it gave you are removed from your Wallet.
Chargebacks are recorded on your account. Chargeback abuse is fraud and can lead to your account being suspended or closed.
Suspension, Closing and Deleting Accounts
If we suspend or close an account, the Coins in its Wallet are not touched; only the Orders described in Cancellations and Refunds are refunded. We may hold Coins and earnings connected to fraud, a chargeback or payments outside Buddie until the matter is settled.
Accounts are deleted by our support team on request. We can't delete an account while it has an open Order (as a Customer or a Buddie), earnings still in a payout hold, or a withdrawal waiting to be paid; those are finished or cancelled first.
When your account is deleted you lose access to its Wallet. Coins you topped up can't be refunded or withdrawn, so spend them — and withdraw any earnings you can — before you ask us to delete it.
Your Rights as a Consumer
If you are a consumer in the UK or the EU, the law gives you rights that this Agreement can't take away. Services must be provided with reasonable care and skill and as described.
You normally have 14 days to cancel a contract for services or digital content you buy online.
Orders: by paying for an Order, you ask for the Service to begin straight away, within your cancellation period, and you agree that you lose your right to cancel once the Service has been fully provided. Before the Session starts you can cancel as described in Cancellations and Refunds. If you want to cancel a Session that has started but isn't finished, open a support ticket; we will refund the part not provided where the law requires it.
Top-ups, tips, gifts, subscriptions, wish contributions and badges are supplied immediately, and by buying them you ask us to supply them straight away. Top-ups are not refunded automatically and Coins can't be cashed out. If the law gives you the right to cancel a top-up or to get back Coins you haven't spent, open a support ticket and we will refund the unspent amount to your original payment method as the law requires; those Coins are then removed from your Wallet.
If a Service wasn't provided as described, report the Order before its payout hold ends (see Payout Hold and Reports), or open a support ticket.
Liability
Our liability is set out in Terms › Limitation of Liability. In short, for anything we are allowed to limit, our total liability to you is the greater of US$50 and the amount you paid us in the three months before the claim. Buddies provide their Services themselves; we are not liable for what a Buddie does or doesn't do, but we hold Customers' payments and handle refunds as this Agreement describes.
Complaints and Disputes
We give support by tickets only — open one from Help › Support. There is no live chat or phone support. If you can't sign in, email support@buddie.gg.
A problem with an Order is best raised with the report button on that Order, before its payout hold ends.
This Agreement is governed by the law of England and Wales, and the courts of England and Wales can hear disputes. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. If you live in the EU, you keep the protection of the mandatory consumer laws of your country and can bring a claim there.
Changes to This Agreement
We may update this Agreement when Buddie, our fees or the law change. The date at the top shows the latest version. For important changes we will tell you by email or on Buddie before they take effect. Changes don't apply to Orders already paid, or to subscription periods already paid for. If you don't agree, you can stop using Buddie.
